Here’s the long version: Because legally, we have to post it. At Shamans Directory LLC, we take your privacy seriously. We recognize the importance of protecting information we may collect from users of our website, www.shamansdirectory.com, and services and/or content provided there. We only ask you to provide information that we need in order to deliver the services or information you have requested. Information and data provided by you or collected as a result of your visits to or use of our website, services, and/or content is subject to our privacy provisions contained herein.

INTERNATIONAL USERS

We maintain information in The Netherlands and in the United States of America (“United States”), in accordance with the laws of the United States, which may not provide the same level of protection as the laws in your jurisdiction. By using the website, services, and/or content provided there, and providing us with information, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy.

THE TERMS AND POLICIES REGARDING YOUR PRIVACY SET FORTH HEREIN (THE "PRIVACY POLICY") SHALL GOVERN YOUR VISIT TO AND USE OF THE WEBSITE PROVIDED BY SHAMANS DIRECTORY LLC ("SHAMANS DIRECTORY," "US," "OUR," OR "WE") AT SHAMANSDIRECTORY.COM (THE "SITE"), AS WELL AS ANY AND ALL INFORMATION, CONTENT, AND SERVICES ON OR RELATED TO THE SITE (THE “SERVICES”). BY ACCESSING OR USING THE SITE OR SERVICES, YOU EXPLICITLY AGREE TO COMPLY WITH AND BE BOUND BY THIS PRIVACY POLICY, WHICH IS ALSO INCORPORATED BY REFERENCE INTO THE TERMS AND CONDITIONS FOUND HERE. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU MUST DISCONTINUE USING THE SITE AND SERVICES.

GENERAL

Changes to Privacy Policy. We reserve the right to change the terms and policies of this Privacy Policy at our sole discretion. Unless otherwise specified, any changes or modifications will be effective immediately upon posting to the Site, and your continued use of the Site or Services will constitute your acceptance of such changes or modifications. 

Electronic Form/Communications. By accessing or using the Site or Services, you consent to having this Privacy Policy provided to you in electronic form and to receiving communications from us electronically. Although we reserve the right and may communicate with you by postal mail, e-mail or by posting notices on the Site, at our sole discretion, you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirements that such communications be in writing, including renewal notices and notices about your membership or account.

INFORMATION WE COLLECT

Definition. For purposes herein, Personally Identifiable Information is defined as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.

Information You Provide. You can visit and use the Site and some Services without revealing any personal information about yourself. However, you may voluntarily provide a name and email address, that we may use to send you e-mail newsletters, notifications, or other information. Other Services require some Personally Identifiable Information from you in order for you to use them. At this Site, your Personally Identifiable Information is collected from you when you use the Site and Services to perform certain tasks, such as:

i) When you post or comment on an article or authored post, or send email to us (such as your name and email address).

ii) When you send email to a member listed in the directory (such as your name and email address) or when you email a friend about a member listed in the directory (such as your name and email address and your friend’s name and email address). Please note that we do not read or retain these messages.

iii) When you contact a member using the Site’s contact forms.

iv) When you purchase something from us or make an online donation to us. In such cases, your payment information is submitted directly to the credit card processor, who is responsible for its use and security. 

v) When you register and purchase a membership to be listed in our directory. We collect information that will be used to create your profile in the directory, such as name and email address, as well as such information regarding your qualifications, certifications, the demographic region in which you practice, and your fields of specialty. We collect information for our records (including your mailing address) that will not be displayed as part of your directory profile, but is necessary to accept payment from you.

vi) When you open an email communication from us in your email program, we may use a software technology called “web beacons” that lets us know which emails have been opened by the recipients. This allows us to know how customers respond to certain communications and the effectiveness of our marketing campaigns.

vii) When you purchase or request that an item be sent to you using your postal mailing address.

Information We Collect Automatically. In addition, like most sites, when you interact with our Site and Services, we maintain logs of site usage for purposes such as to evaluate our users' interest level in areas of the website, which and how many pages they look at, how long they stay on the website, and what Web browsers are used. This data is tracked in aggregate form, not at an individual user level, and is not uniquely identifying. The aggregate level data may be shared with third parties and the public.

We also might store some information on your computer in the form of a "cookie" (i.e. a small piece of text that stores information on your browser in your computers hard drive) or similar file.  We do this to collect information about your activities on the website, and/or to prevent you from re-entering data at each connection.  We may also use conversion tracking cookies as part of our ad campaigns in order to analyze trends, gather broad demographic information, and monitor site traffic patterns that can help us further develop and improve the design and functionality of our site. The cookies shall only be used to obtain non-personal information to improve your online experience.  No other information is stored in these cookies.  You can set your browser to notify you when you receive a cookie and delete any cookies you receive.

  • Establishing and administering your account, including conducting billing and invoicing, contacting you about the expiration of your membership and sending you service messages about your membership. For example, once you are subscribed, we may store your membership information, including its start date, renewal date, pricing, publication, and any customer service contacts you may have with us.
  • Authenticating access to your account. For example, you may provide us with a username and password to get access to your account.
  • Delivering requested or purchased products. For example, when you sign up for our newsletter, we use the information we collect to deliver the newsletter.
  • Performing maintenance and operations, including management of the network and devices supporting the Services and our systems.
  • Providing technical support and assuring quality of customer service interactions.

Communicating with You:

  • Responding to your inquiries.
  • Personalizing communications.Sending you service-related announcements, such as to notify you when we make changes to membership agreements, or to contact you about your account.

Making Improvements to Our Offerings:

  • Improving the design of our Site and Services.
  • Identifying and developing new products and services.
  • Understand how our Services are used, including by creating measurement and analytics reports.

Providing Recommendations and Delivering Relevant Advertising:

  • Marketing our Services.
  • Determining which content to recommend to you.
  • Sending you promotional communications (newsletters) for the Site including products and services we think may be of interest to you.
  • Delivering more relevant advertising.

Investigating Illegal Activities and Securing Online Environment:

  • Detecting the unauthorized reception, use, or abuse of the Services.
  • Protecting you and other users and members from fraudulent, abusive, unlawful use of, or subscription to, the Services.

Online Payments and Donations:

If you make a purchase or make a donation to Shamans Directory via our online forms, you will be asked for personal billing and credit card information.  Shamans Directory online payment and donation form is hosted on a secure site, using high-grade encryption and the industry-standard https security protocol to ensure secure transactions. All payments and donations are processed by Stripe. (See https://stripe.com/privacy.)  The credit card information that you provide at the time of the purchase or donation only will be used to process your payment and will not be used for any other purposes.

HOW YOUR INFORMATION IS DISCLOSED

Publicly. The materials you post on the website and related social media accounts, such as articles, authored posts, directory information and comments, are made available to be seen and read by other users of the website. No such materials are treated confidentially. We will remove your materials from the website at your request, but we cannot give any assurances that such materials are not still available from servers maintained by others (such as search engines or proxy servers) or that others have not already downloaded and stored such materials.

Service Providers. We may disclose personal information to our service providers, which are companies that process information on our behalf, without your consent to deliver the Service and conduct business activities. We require the service providers to treat the information we disclose to them, or that they collect on our behalf, as confidential and to use the information only for the purposes for which they have been engaged. The following is a list of categories of our service providers.

  • Billing and collection providers, such as payment processors and organizations that assist us in assessing your credit and payment status.
  • Auditing and accounting firms.
  • Professional services consultants, such as firms that assist with providing legal services, or supplying project-based resources and assistance.
  • Advertising, marketing, and analytics services, including entities that analyze the information we collect from or about you to communicate with and advertise to you.
  • Security vendors, such as entities that assist with security incident verification and response, service notifications, and fraud prevention.
  • IT vendors, such as entities that assist with website design, hosting, and maintenance, data and software storage, and network operation.

There may be limited circumstances in which the service provider collects data directly from you when their privacy policies may also apply.

Authorities. in order to cooperate with legal authorities, Shamans Directory may in some circumstances be required to disclose personally identifiable information in response to requests from law enforcement authorities, or in response to a subpoena or other legal process. In such unlikely circumstances, we will provide only the information required. We may also turn over information about you if we believe we must in order to prevent a violation of the law, and by accepting this policy, you consent to our doing so, at our sole discretion. You also consent to our disclosing information about you in the course of legal proceedings if we are legally required to do so, if we reasonably believe that doing so may mitigate our liability, or if doing so will assist us in enforcing our legal rights.

Marketing Lists. From time to time, we obtain lists of people who may be interested in our products and services from third-party marketing list suppliers. We use these lists to send direct marketing promotions by mail or by email. We do our best to obtain these lists only from suppliers who collect their lists in compliance with applicable law, but we are not responsible for the conduct and policies of these suppliers. Please note that even if you are a registered customer of ours and have asked us not to use the information you provided to us to send you promotional material, a third-party marketing list supplier may still provide us with your name and address. As a result, you may receive the promotional material sent by us to others on the supplier's list. Our Services may provide links to third-party websites or offerings where data privacy practices may be different to that of Shamans Directory. The inclusion of any link does not imply our endorsement of any other company, its websites, or its products and/or services. These linked websites or offerings have separate and independent privacy policies, which we recommend you read carefully. We have no control over such websites or offerings and therefore have no responsibility or liability for the manner in which the organizations that operate such linked websites or offerings may collect, use, disclose, or otherwise treat your personal information.

DATA ACCESS AND SECURITY

Data Access and Erasure. In some jurisdictions you may request copies of your personal information or request that your personal information be deleted (see e.g, section below on California Consumer Privacy Act). Data deletion requests are subject to certain exceptions: for example, if your data is necessary to comply with legal obligations. To exercise your rights, please send a request via email to support@shamansdrectory.com with the subject line "Personal Data Request" that (1) provides sufficient information to allow us to verify that you are the individual or represent the individual about whom we have collected Personal Data, and (2) gives us sufficient information to understand and respond to it. We will work to respond within the mandated time frame. 

Data Security. We have put in place administrative, technical, and physical safeguards to help prevent unauthorized access, maintain data security, and correctly use the information we collect. 

Retention of Personal Information. We will retain your personal information while you have an account with us and thereafter for as long as we have a legitimate need to retain it. Thereafter, we will either delete your personal information or de-identify it so that it is anonymous and not attributed to your identity.

Limitations. No system can be completely secure, and we do not guarantee that unauthorized disclosures and access will not happen.

CALIFORNIA PRIVACY RIGHTS

California Consumer Privacy Act. The California Consumer Privacy Act (“CCPA”) grants residents of California certain rights with respect to their personal information and requires us to provide such individuals with certain information, as described in this Section.

Deletion. You have the right to request that we erase data we have collected from you. Please note that we may have a reason to deny your deletion request or delete data in a more limited way than you anticipated, e.g., because of a legal obligation to retain it or to provide a good or service that you request. You can make this deletion request by following the procedure in the Exercising Your Information Access and Information Deletion Rights below.

Opt-Out of Sale. You have the right to request that we stop “selling” your personal information as that that term is defined in the CCPA. Categories of personal information we collect. We collect the categories of information described above in the “Information We Collect” section for the purposes described in the “How We Use Your Information” section.

We may disclose any of the categories of personal information listed above and use them for the above-listed purposes or for other business or operational purposes compatible with the context in which the personal information was collected. Our disclosures of personal information include disclosures to our “service providers,” which are companies that we engage for business purposes to conduct activities on our behalf. We may “sell” (as the word is defined in the CCPA) any of the categories of personal information listed above to third parties, except for Professional or employment-related information; and Education information. Exercising Your Information Access and Information Deletion Rights

To exercise the Information Access and Information Deletion rights described above, please submit a verifiable request to us by either of the following methods: 

You may make a verifiable request for information access not more than twice within any 12-month 

period. The verifiable request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of such person; and
  • include sufficient detail that allows us to properly understand, evaluate and respond to the request.

MISCELLANEOUS

Children’s Privacy. We are committed to protecting the privacy of children. You should be aware that our website is not intended or designed to attract children, and we limit the right to use our site under our Terms of Service to the age of 18 or that of legal majority. We do not collect personally identifiable information from any person we actually know is under the age of 18.
